HTC Phones face US ban after Apple patent win

In yet another legal battle, HTC has been found reeling ever since it has entered into a duel with Cupertino technological giant, Apple. While, the world has witnesses numerous patent wars in recent past, this has turned out to be a trickier one. With memories of its marathon controversy with Samsung still afresh, Apple has earned a ‘dubious’ reputation of controversy embroider, by getting into yet another duel with HTC. This got surfaced in a detailed manner during the hearing at US International Trade Commission. Apple has accused HTC of breaching into its patented stuffs. What seemed to be quite concrete in favor of Apple is HTC has reportedly breached in having access to an interface, which counts to infringement of 1 out of 10 patents. However, during the trial, it has been found that HTC has violated on 1 out of total 10 claims, made by Apple. The panel of ITC has also dismissed 2 out of 4 claims, on the withstanding patent hearing upheld in the previous resolution.

Again, HTC has also got something to speak in its defense. According to HTC officials, the infringing rudiments classified by ITC involves and influences just a negligible portion of the user interface and they have assured to remove it at the earliest apart from selling non-infringing products.

This version though did not seem to have interested and convinced Apple. By ‘negligible portion’, HTC admits to have been involved in tapping data, where the information is seized in the form of phone number, e-mail address in order to use it somewhere else later on. It is more or less like ‘cut, copy, paste’ process, if spoken in simpler language.

If experts and analysts are to be believed, this could have an adverse effect on HTC’s US sales. On the other hand, HTC still has got time to work upon its word. It has been given time till April to comply by the rules and remove the infringed feature to put an end to this spat. It’s believed; this would not come off as a major setback for HTC, since these features would go one to become quite older by then.

The ongoing duel between Apple and HTC has already passed through enough zigzags. On one occasion, HTC even blamed Apple of breaching its patents, which was ruled out by ITC, with final judgment awaited in February.

Right now, both Apple and HTC, must have kept their fingers crossed, working and re working on their strategies. The hype and heat generated by this duel has been a kind of spoiler for both parties. The final judgment, yet to be delivered, is expected to be out by 19th April. Of course, when things turn bitter between two leading business houses, the entire market feels the ripple. However, on a positive note, a better and befitting outcome could not be ruled out, with an amicable resolution cooling off the fumes of both camps.
